Consultation to remove the defence of reasonable punishment of children

Every response counts – please respond before the consultation closes on Monday 2 April 2018.

It is against the law for a parent or carer to smack their child, except where this amounts to ‘reasonable punishment’ (section 58 Children Act 2004).

The Welsh Government is consulting on the development of a legislative proposal to remove this defence. This would not create a new criminal offence, but would remove a defence to the existing offence of common assault or battery.

We are encouraging everyone to respond to this consultation – individuals as well as organisations. Also, please share with your colleagues, family and friends. 

All the questions don't have to be answered but question 1 is critical:

Do you think our legislative proposal to remove the defence of reasonable punishment and prevent the use of corporal punishment will help achieve our stated policy aim of protecting children's rights? (Yes/No/Don't know) If not, why not?
